I understand all riders/participants must check in! You must sign a liability waiver/release form to participate in The Parade. The Parade will take approximately 2 hours to complete. The Parade will start promptly at 9:00 am. Appropriate attire is required for riding, including crepe-soled or hard soled boots/shoes. If you are walking, dress comfortably in Western attire or in your Service Uniform. All wagons and floats must have brakes. No alcohol will be permitted. All firearms must be free of ammunition. Shooting of blanks is prohibited. No throwing items of any kind, walkers may hand out items.
RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
Activity Description: Cave Creek Rodeo Days Parade
In consideration for being permitted to enter and participate in the above listed events on the grounds of the Town of Cave Creek, Owners of Record of Parcel No: 211-09-007G and Parcel No: 216-07-008 TC, and on the town Maintained Roads, in Cave Creek, Arizona, and in particular for being permitted to utilize the grounds and facilities provided by Town of Cave Creek, Owners of Record of Parcel No: 211-09-007G and Parcel No: 216-07-008, in Cave Creek, Arizona for the stabling or riding of horses, whether in conjunction with riding in a specific, group, rides or other events offered thereby or otherwise, or to participate or engage in any other activity offered to the public by the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, the Town of Cave Creek, along with our Sponsors and Advertisers, their agents, officers, employees and volunteers, THE UNDERSIGNED for himself/herself and his/her personal representatives, heirs and next of kin acknowledges, agrees and represents that he/she has, or will immediately upon entering said grounds, or engaging in said activity, will continuously thereafter exercise due diligence to determine that said grounds are safe and that all necessary precautions have been taken with regard to said activity and that said activity is conducted in a continuing safe manner. The undersigned does further warrant that his/her entry upon said grounds and his/her initial and continuing participation in said activity or activities constitutes an acknowledgement that he/she has exercised such diligence and that if, at any time, that he/she is on said grounds or participating in said activity and he/she becomes aware of anything that he/she believes to be unsafe, he will immediately notify the Town of Cave Creek and a Board member of the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, and shall either leave that portion of the grounds or cease participating in said activity as soon as possible.
THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, the Town of Cave Creek, along with our Sponsors and Advertisers, their agents, officers, employees, volunteers and Owners of Record of Parcel No: 211-09-007G and Parcel No: 216-07-008, in Cave Creek, Arizona; employees or agents of the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, the Town of Cave Creek, along with our Sponsors , Advertisers, their agents, officers, employees and volunteers and Owners of Record of Parcel No: 211-09-007G and Parcel No: 216-07-008, in Cave Creek, Arizona or any persons present on said grounds or participating in any activities on said grounds (All for the purposes here referred to as “Releasee(s)”:; from all liability to the undersigned, his personal representatives, assigns, heirs and next of kin for any and all loss or damage, in any claim or demand therefore on account of injury to or death of, the person or property of the undersigned whether caused by negligence of the Releasee(s) or otherwise while the undersigned is on said grounds and/or participating in said activity.
THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY, SAVE AND HOLD HARMLESS the Releasee(s) and each of them from any loss, liability, damage, expense or cost that may incur due to the presence of the undersigned on said grounds or due to the participation of the undersigned in said activity and whether caused by the negligence of the Releasee(s) or otherwise.
THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR ALL RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of Releasee(s) or otherwise while on said grounds, while property is in the care or control of the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, the Town of Cave Creek, along with our Sponsors and Advertisers, their agents, officers, employees and volunteers, and/or any volunteer, employee or agent of the these entities, while participating in said activity.
THE UNDERSIGNED EXPRESSLY ACKNOWLEDGES and agrees that said activities could be dangerous and involve risk of serious injury, death, and/or property damage. The undersigned further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as abroad and inclusive as is permitted by the Law of Arizona and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
THE UNDERSIGNED EXPRESSLY ACKNOWLEDGES the under Arizona law, an equine activity sponsor or equine professional is not liable for injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to A.R.S. 12-553.
THE UNDERSIGNED, HEREBY ASSUMES FULL RESPONSIBILITY FOR AND ALL RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of Releasee(s) for the undersigned’s minor children or any person(s) whom the undersigned is the legal guardian of while supervised, unsupervised or otherwise while on said grounds, as if a full and separate release has been executed on behalf of each minor child. It is understood that all minor’s on property that are not under the direct supervision of an agent of the Cave Creek Rodeo Days Organization, the Cave Creek Rodeo Days Committee, the Town of Cave Creek, along with our Sponsors and Advertisers, their agents, officers, employees and volunteers are to be supervised at all times by their Parent or Legal Guardian.
THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THIS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
THE UNDERSIGNED hereby represents that he/she is at least eighteen (18) years of age, or if not, this Release and Waiver has been signed by his/her parent or legal guardian. The undersigned parent or legal guardian hereby agrees to be bound by the terms of this Release and Waiver for and on behalf of the undersigned minor child or ward.
